Negative Portrayals of Muslims Get More Media Attention

Since 9/11, negative messages about Muslims have received more media attention than positive ones, new research finds.

This pattern is despite the fact that fear- and anger-based messages were on the fringe between 2001 and 2008, the scientists add. However, the media's intense focus on organizations putting out negative messages seems to have strengthened those group's positions.

"There are consequences of this media coverage, so that fringe organizations can actually come to redefine what we think of as mainstream," study researcher Christopher Bail, a sociologist at the University of North Carolina and the University of Michigan, told LiveScience.

Muslims in the media

After the terrorist attacks of Sept. 11, Bail became interested in the public discourse surrounding Islam. Controversies about the faith have regularly arisen since 2001, including Florida pastor Terry Jones' promise to burn Korans in 2010, considered an affront in Islam, and a recent anti-Muslim film that triggered riots around the world.

Bail wanted to understand how private organizations with pro- and anti-Islam agendas interacted with the media. He collected 1,084 press releases from 120 organizations, including Muslim groups, evangelical Christian groups and think tanks with various interests. He then compared these press releases with 50,407 newspaper articles and television transcripts from 2001 to 2008 to find out which organizations were best at influencing media coverage. Bail analyzed articles from the New York Times, USA Today and the Washington Times, as well as from CBS, CNN and Fox's television broadcasts to ensure a wide range of ideologies.

He found press releases that were emotional, displaying fear and anger, had the best chance of getting the media's attention (85 percent of all the press releases went unnoticed by journalists). Not only that, but the least representative messages got the most attention.

"The groups that were getting the majority of the attention, especially after 9/11, were some of the least representative groups, or what I call fringe groups," Bail said.

These groups aren't part of the tin-foil-hat crowd, Bail added; by fringe, he means not that the groups lack influence, but that their messages were unlike most others.

Emotions get attention

For example, Muslim organizations put out many messages condemning terrorism, in response to nearly any incident, Bail said. But these press releases were usually dispassionate or mournful, and they received little media coverage.

But Muslim groups often put out angry and emotional messages in response to cases of discrimination against Muslims. These messages got more media attention. To the newspaper-reading and TV-watching public, the impression is that Muslims care little about condemning terrorism and are over-sensitive to Islamophobia, Bail said.

This, in turn, convinces anti-Muslim organizations that they're right and Muslims are trying to advance Islamic law (known as "Sharia") under the guise of political correctness, he added.

The "fringe effect" of rare emotional messages getting the most attention also boosts anti-Muslim groups who put out frequent angry press releases. An analysis of financial records from the IRS and social strength of anti-Muslim groups (as measured by networks of board members in the organizations) found that increased media influence helped groups cement their power over the course of the years studied.

"What happens in the media matters to the groups themselves," Bail said.

There's likely no single answer to getting more representative coverage of pro- and anti-Islamic attitudes, Bail said. Muslim groups could inject more emotion into their condemnations of terrorism in hope of getting more attention, he said. There is also frustration in the Muslim community that reporters only come around when they want a comment on something negative, such as terrorism or war.

Perhaps most importantly, consumers of news can keep a healthy skepticism when reading articles or watching reports about Islam.

"When we look at the media we have the tendency to assume these groups have been thoroughly vetted and that they are representative of what is going on," Bail said. "Often, I think my study shows, it's actually the opposite. It's groups that are very unrepresentative."

The findings appear today (Nov. 29) in the journal American Sociological Review.

Cancer drug shows promise in eradicating latent HIV infection

ScienceDaily (Nov. 29, 2012) ? Breakthrough drugs have made it possible for people to live with HIV longer than ever before, but more work must be done to actually cure the disease. One of the challenges researchers face involves fully eradicating the virus when it is latent in the body. A new report appearing in the December 2012 issue of the Journal of Leukocyte Biology suggests that a cancer drug, called JQ1, may be useful in purging latent HIV infection by activating the virus in the presence of potent therapy -- essentially a dead end for the virus.

"This drug may be useful as adjunctive therapy in efforts to purge latent HIV reservoirs to eradicate infection," said Monty A. Montano, Ph.D., principal investigator from the Section of Infectious Diseases at Boston University Medical Campus, in Boston, Mass. "This drug functions synergistically with other HIV purging agents."

To make this discovery, scientists used cell lines that contained latent HIV, as well as cells from patients who were on potent antiretroviral therapy with no detectable virus in their blood. Researchers then added JQ1 to latently infected cells, at physiologic concentrations, and observed potent reactivation of latent HIV. The researchers also observed potent suppression of inflammatory genes in genome-wide expression studies using the same cells. JQ1 reactivation of latent HIV may make it vulnerable to current therapies.

"One thing that's been made clear by the decades of HIV research is that there is no magic bullet for curing this disease," said John Wherry, Ph.D., Deputy Editor of the Journal of Leukocyte Biology. "Rather, the progress that's been made has been a series of incremental steps that often build on other previously developed therapies. The hope is that the ability of JQ1 to make latent HIV 'visible' to other HIV drugs described in this report will be another cog in the gearwheel of an HIV cure."

Family Holiday Traditions That Warm Our Hearts During The Season

Our reader Jocelyn C. has this to share, Christmas brings back so many wonderful memories of my Christmas's growing up and also raising my boys and making it special for them passing on those heart felt traditions. It is truly a magical time of year when the presence of God glistens with love and hope for the coming year.

To start off the holiday season, we asked our clients and readers what they liked best about the holidays and here are five categories of their answers:

One: Gift giving
Whether it is a tray of homemade cookies, box of chocolates or a Thomas the Tank train set, gift giving is a great way to share and bring cheer during the holiday season.

Our reader Abigail K. said:
I love the tradition of our whole family gathering at my moms to open presents early on Christmas morning, before we open our presents my dad prays and thanks God for our family and for blessing us and the ultimate gift of knowing him. It's beautiful way to start Christmas then we all open presents and spend family time together. That's what Christmas is about the best of both!!

Susan H.:
The thing I like best about the holidays is family and the spirit of giving.

Seeing the expression on my family's face when they open an oil they weren't expecting to ever try for themselves:) Truly a fulfilling feeling.

Two: Spending time and feasting with family and friends
Most people take a week off from school or work to spend time with family and friends. They travel near and far to be together to strengthen connections, love on each other and eating together.

Some might take time to shop, cook or bake together. Grandparents or older relatives may visit and share stories about their younger days and share family customs and traditions. This will strengthen ties and values.

One of the greatest gifts of all is the gift of time for your parents, grandparents, grandchildren and children.

Some of us collect Christmas ornaments every year and past them down to the next generation. The way we decorate our homes shows our tradition and beliefs.

'Chill-coma' recovery: Cold cricket case could defrost mysteries of changing climate

ScienceDaily (Nov. 28, 2012) ? Biologists from Western University have discovered that insects recover from chill-coma by getting water and salt back where it belongs. These findings, published online today by Proceedings of the National Academy of Sciences (PNAS), not only identify the very mechanisms that drive insect movement at low temperatures but will lead to a better understanding of agriculture management, biodiversity and climate change.

Wildlife photographers often pose insects by cooling them down in a refrigerator, where they enter a paralyzed state called chill-coma. Insects in chill-coma appear dead, but are still very much alive. If the shutterbug is patient, he or she will witness the bug as it awakens. Chill-coma was first noted more than a century ago and photographers are not the only ones who have found use for it.

Many alpine spiders prey on insects that have inadvertently landed on snowfields and have gone into a chill-coma while biologists, like Western professor Brent Sinclair and his PhD student Heath MacMillan, use chill-coma recovery as a way to measure insect cold tolerance. A research team, led by MacMillan, studied recovery from chill-coma in fall field crickets and found that recovery depends on fixing the water and salt imbalances that materialize when the insect is cold.

"Insects lose the ability to maintain proper water balance in the cold so when they are chilled, water and sodium move from the insect blood, called hemolymph, into their gut," says MacMillan. "This is bad for the insect because it concentrates potassium in the blood that remains, which leaves muscles unable to function."

To get their muscles working again, crickets restore normal hemolymph potassium concentration, which can occur in a matter of minutes. But just because the insect can move, which MacMillan notes is useful when insects don't wish to be eaten, doesn't mean its physiology has returned to normal.

"Crickets still need to restore sodium and water balance," explains MacMillan. "We measured the metabolic cost of this reboot and found that the process increased a cricket's metabolic rate by as much as 50 per cent for a few hours."

"This work is significant because it allows us to identify the mechanisms that drive insect movement at low temperatures," adds Sinclair. "This will lead to a better understanding of the biology of pest and beneficial insects during cold snaps at any time of year, and maybe help us to predict how different insects respond to changing conditions. This will also help us manage agriculture and biodiversity in a changing climate."

People?who want the latest game device?to hit stores?and don't mind dropping $300 or more to get it?have been busy grabbing up Nintendo's brand new Wii U game machine with its?tablet controller. But on Tuesday, the Japanese company revealed a gaming device?for those who don't mind owning older technology and need to stick to a budget.

It's called the Wii Mini???it's the older-model?Wii game machine now in a smaller size?and with a $99.99 price tag.?Alas, the Wii Mini, which launches Dec. 7, will only be available in Canada. At least for now.

Nintendo first launched its Wii game console?with motion-sensing controllers back in 2006.?Nintendo announced Tuesday that the Wii Mini is not only?smaller than the original, it?is designed only to play games???that means it's been stripped of its online capabilities (no streaming Netflix, for example) and it does not play older GameCube games.

The?Wii Mini does come come packaged with a Wii Remote Plus and a?Nunchuk controller.

Nintendo says the?Wii Mini will be available exclusively in Canada during the holiday season. What about after that? "No information is available about its potential availability in other territories in the future," Nintendo said in the?announcement.

Although Hazel Belvo?s Drake Gallery Exhibit, Four Decades of Painting, covers selections of her work from 1974 to 2011, the story of her love of art reaches far before then.

Belvo taught in the art department at St. Paul Academy and Summit School from 1972 to 1989. Belvo?s art has been exhibited for 50 years and can be found in many collections including the Minneapolis Institute of Art and Minnesota Historical Society.

Along with Upper School Arts Department Chair Marty Nash, she is part of the Women?s Art Resources of Minnesota, a group for women artists. Belvo is also a retired chair of the Division of Fine Art at MCAD and an instructor at Grand Marais Art Colony, where artists gather from all over the world. She and her partner, Marcia Cushmore, share a studio in Minneapolis.

?I would say I am a storyteller and I like stories, I like narrative,? Belvo said. ?So the paintings that you see here in this studio, they all have a story.?

For example, Belvo?s painting of a large tree, which hangs near the entrance of the gallery, depicts a certain tree on the North Shore, called the Spirit Tree by the Objiwas. The Spirit Tree has been the subject of many of Belvo?s paintings since 1961.

When Belvo was a little girl in the 1920?s and 1930?s, she lived on a farm that had a pond. The roots of trees around the pond often curved down into the water. Because of this, Belvo acquired special awe for trees in the early years of her life.

Belvo?s exhibit in the Drake Gallery tells the story of major changes in Belvo?s life, too. In the spring of 1972, Belvo?s oldest son died of leukemia. ?One of the things that happened to me was that I couldn?t stand loud noises and everything was so raw in feeling,? Belvo said. ?And I couldn?t stand strong color.? Because of this, most of Belvo?s paintings in the 70?s are almost all white.

Belvo didn?t begin to paint with vibrant colors again until the hospital where Belvo?s son passed away later commissioned her for a painting. ?Color has always been really instrumental in my work; maybe one of the main focuses of the visual language is color,? Belvo said.

Belvo says people might call her an ?old-fashioned painter.? ?I think of [painting] as carving out the surface, what you want to do is give the surface life? and I can do it with a brush better than anything else, I think,? she said.

To Belvo, art is ?making something that wasn?t there, making something internal become external so that you can see your inner life.?

?My whole life is about art; it?s such a privilege,? she said. The most magical aspect of being an artist is how fast time flies as she works. ?You go in a studio and pick up a brush, maybe it?s ten o?clock in the morning. Before you know it, it?s three o?clock in the afternoon, and you don?t know what happened, it?s just all there in front of you,? Belvo said.

Aside from her studio in Minneapolis, Belvo also paints at a house on Lake Superior with her partner for five months every year. There, she can experience the riches of nature as much as possible, especially because it allows her to ?have one foot on land and one foot in the water,? Belvo said. ?Being in the house is like being on a ship.?

Belvo?s exhibit in the Drake Gallery began Nov. 1 and will end Nov. 30. She?s excited to be back at St. Paul Academy and Summit School and see some of the people who have been part of the SPA community since she worked here.

Currently, Belvo is also painting a series of 22 paintings called Resurrection that she hopes to find a venue for. Additionally, she has a show at the Bockley Gallery in the April and May of next year that will showcase many of her works on trees.

Belvo co-creates the Art Department

Imagine stepping 40 years back through time and walking through the art hallway. Instead of pots clicking against each other on a shelf and easel after easel of student work, there was barely anything but a Shakespeare room on one side and a few tables. No one took art classes, and the idea of an art department was still fresh and new.

Tom Reed, the headmaster of St. Paul Academy and Summit School at that time, had heard of Belvo?s work at the Bunting Institute at Harvard. Reed asked for her help in building a fine arts department for the school, and Belvo agreed.

Belvo arrived at SPA in 1972, and with current Upper School Ceramics teacher Bob Jewett, pioneered an artistic revolution at SPA that lasts to today. Some of their goals were to ?equip the studio as if it was going to be a professional studio and treat our students as if they were going to be artists,? Jewett said.

Soon, art classes were set up, and students began to win competitions. Other private schools, such as Blake, Breck, and Mounds Park Academy, sought to model their art department after SPA?s. ?I would say [Belvo]?s a genius at teaching kids how to draw and tap into their inner selves,? Jewett said. ?We were young and so there was a tremendous sense of enthusiasm and energy.?

Mentoring others has always had a special place in Belvo?s heart. ?I love teaching, because I think teaching and making art is like one and the same,? she said.

Because of what Jewett described as ?her steadfast belief in herself as an artist,? Belvo organized ways for artists to come in and talk to students. Art festivals occurred in which professionals, ranging from potters to glass blowers, set up demonstrations in the courtyard and raised money for the school.

Belvo also helped students paint the Adam and Eve mural in the lower library, which many students walk by today. ?There was a real shared sense of purpose and what was important and that kind of focus has continued on,? Jewett said. In 1989, Belvo left SPA to teach at the Minneapolis College of Art and Design (MCAD).

?I loved every year, every bit of the time I spent at St. Paul Academy.? Belvo said. ?It was very hard to leave.?

FDA suspends operations at peanut butter plant

WASHINGTON (AP) ? The Food and Drug Administration is cracking down on a New Mexico peanut butter plant that had repeated food safety violations over several years, using new authority to halt operations at facilities that may be producing unsafe food.

The agency on Monday suspended the registration of Sunland Inc., which is the country's largest organic peanut butter processor. FDA officials found salmonella in numerous locations in Sunland's processing plant after 41 people in 20 states, most of them children, were sickened by peanut butter manufactured at the Portales, N.M., plant and sold at the Trader Joe's grocery chain. The company had announced plans to reopen its peanut processing facility on Tuesday after voluntarily shutting down earlier this fall.

The FDA gained the new authority to suspend companies' registrations in a food safety law signed by President Barack Obama in early 2011, and this is the first time the agency has used it. The ability to shut down the company's operations is a step forward in an FDA effort to stem a growing number of widespread outbreaks like the salmonella illnesses linked to the peanut butter, said Michael Taylor, the FDA's deputy commissioner for foods.

Before the food safety law was enacted, the FDA would have had to go to court to suspend a company's registration.

"We would have had to go to court and build a case," Taylor said, stressing that the burden will now be on the company to prove it is safe.

Sunland had closed its peanut processing facility after the September outbreak. It planned to reopen this week with hopes of selling peanut butter again by the end of the year. Sunland spokeswoman Katalin Coburn said the FDA's decision to suspend the registration was a surprise to the company and Sunland officials had assumed they would be allowed to resume operations.

The company now has the right to a hearing and must prove to the agency that its facilities are clean enough to reopen. Coburn said Sunland is cooperating with the FDA and company officials hope they can be operating again soon.

Besides organic peanut butter, Sunland also produces many non-organic products. The company recalled hundreds of organic and non-organic nut butters and nuts manufactured since 2010 after Trader Joe's Valencia Creamy Peanut Butter was linked to the salmonella illnesses in September.

In addition to Trader Joe's, Sunland sold hundreds of different peanut products to Target, Safeway, Whole Foods and other large grocery chains. Many of the grocery stores repackaged Sunland products and sold them under their own names.

After the outbreak linked to Sunland and to Trader Joe's, FDA inspectors found samples of salmonella in 28 different locations in the plant, in 13 nut butter samples and in one sample of raw peanuts.

The agency also found improper handling of products, unclean equipment and uncovered trailers of peanuts that were exposed to rain and birds outside the facility.

The FDA said that over the past three years, the company shipped products even though portions of their lots, or daily production runs, tested positive for salmonella in internal tests. The agency also found that the internal tests failed to find salmonella when it was present.

FDA inspectors found many of the same problems, including employees putting their bare fingers in empty jars before they were filled, open bags of ingredients, unclean equipment and many other violations, in a 2007 inspection. Similar issues were recorded by inspectors in 2009, 2010 and 2011, although government officials didn't take any action or release the results of those inspections until after the illnesses were discovered this year.

In a statement issued earlier this month, Sunland's president and chief executive officer, Jimmie Shearer, denied the company knowingly shipped tainted products.

"At no time in its 24-year history has Sunland Inc. released for distribution any products that it knew to be potentially contaminated with harmful microorganisms," Shearer said in a statement posted on the company's website. "In every instance where test results indicated the presence of a contaminant, the implicated product was destroyed and not released for distribution."

A separate peanut butter outbreak in 2009, not related to Sunland, was linked to hundreds of illnesses and nine deaths.

President Barack Obama announced Monday he had picked Securities and Exchange Commissioner Elisse Walter to replace outgoing Chairman Mary Schapiro, who plans to step down in mid-December. Schapiro has helmed the agency since January 2009, winning confirmation with the economy shaken to its core by the global financial meltdown.

Walter is a former top official of the Financial Industry Regulatory Authority, Wall Street's industry-funded watchdog. She does not need Senate confirmation to her new post.

The new SEC chairman will likely find herself in the thick of a fight over financial industry regulations known as Dodd-Frank. Some Obama aides have said the president hopes to improve aspects of the law, while Republicans insist they want to roll back many of its provisions. And big banks want a say in how the new rules are implemented.?

Obama praised Schapiro for her stewardship of the SEC during a critical time.

"When Mary agreed to serve nearly four years ago, she was fully aware of the difficulties facing the SEC and our economy as a whole," Obama said in a statement. "But she accepted the challenge, and today, the SEC is stronger and our financial system is safer and better able to serve the American people?thanks in large part to Mary's hard work."

"I'm confident that Elisse's years of experience will serve her well in her new position, and I'm grateful she has agreed to help lead the agency," the president said.

Russia's Medvedev criticizes France for backing Syrian rebels

MOSCOW (Reuters) - Russian Prime Minister Dmitry Medvedev, speaking before a visit to Paris on Monday, criticized France's support for the Syrian opposition and accused European Union leaders of indecisiveness in dealing with the region's economic crisis.

France became the first European power to recognize Syria's new opposition coalition as the sole representative of its people and said on November 13 it would look into arming rebels against President Bashar al-Assad once they formed a government.

Medvedev, who stepped down as president in May to make way for Vladimir Putin, said such a decision was "unacceptable".

"The desire to change a political regime in another state through recognition of some political force as the sole sovereign representative seems to me not entirely civilized," Medvedev told French journalists in an interview cleared for publication on Monday.

Medvedev echoed Putin's statements that Russia takes a neutral stance and is not seeking to prop up Assad, saying that "Russia supports neither Assad's regime nor the opposition."

"But ... the question is how right it is to ... decide to support another political force if that political force is in direct confrontation with the officially recognized government of another country. And from the point of view of international law, it seems to me that is absolutely unacceptable."

Russia and France have been sharply at odds over Syria during a conflict activists say has killed more than 38,000 people since protests began in March 2011. France and other Western states have criticized Russia for vetoing three U.N. Security Council resolutions aimed to pressure Assad.

DEFENDS RUSSIA

Medvedev is to meet French President Francois Hollande and Prime Minister Jean-Marc Ayrault during his two-day visit, the first meeting of an intergovernmental commission since Putin and Hollande took office in May and Medvedev and Ayrault took up their posts. Most meetings are expected to occur on Tuesday.

Medvedev said that Russia, which holds 41 percent of its gold and forex reserves in euros, has been closely following the crisis management of the EU, which accounts for half of Russia's foreign trade.

"We are following it with suspense because sometime it seems to us that our European partners lack energy and will in their decision-making," Medvedev said.

Medvedev also accused France of setting up administrative barriers for Russian investors, often viewed in the West with suspicion over the origin of their money made in controversial privatizations of the 1990s.

"It is time to relax and understand that most Russian businessmen are law-abiding people who made their money in an honest way, and this money can be invested in any assets, including French ones," Medvedev said.

He defended new laws Kremlin critics have described as a crackdown on dissent since Putin's election to a six-year third term, and contended Russia has advanced democracy since a wave of opposition protests began last December by allowing more parties to contest elections.

Some analysts believe Medvedev may not hold his job for much longer. But Medvedev said he felt "comfortable" as prime minister under Putin - a reversal of their roles from 2008-2012, though Putin was always seen as calling the shots - and repeated that he did not rule out seeking the presidency again.

(AP) ? Grammy-winning jazz bassist Marcus Miller and several members of his band were injured when their bus overturned Sunday on a busy highway in Switzerland, killing the driver, police said.

The German-registered private bus tipped over as it drove into a bend on the A2 highway in central Switzerland and came to a rest on its side, police in the canton (state) of Uri said. The bus was carrying 13 people ? two drivers and 11 members of the Marcus Miller Band, including Miller.

Over his career, the bassist has worked with jazz greats such as Miles Davis, Dizzy Gillespie and Wayne Shorter, according to his website. He won two Grammys, his first coming in 1991 for Best Rhythm & Blues Song ("Power of Love") along with Luther Vandross and Teddy Vann, and the second came in 2001 for Best Contemporary Jazz Album ("M2").

The band was on its way from Monte Carlo to the Dutch town of Hengelo, the next stop on the American band's tour, where it was due to perform Monday.

The driver who was at the wheel at the time of the accident sustained fatal injuries. Police spokesman Karl Egli said the 12 passengers were injured and taken to hospitals, but none had life-threatening injuries.

Miller was discharged from the hospital later Sunday, as were fellow band members Alex Han and Kris Bowers, but some other band and crew members were being kept in hospitals overnight, according to a post on Miller's official Facebook page.

The cause of the accident was not immediately clear. Police believe no other vehicles were involved.

While a majority of America is keenly aware of the housing bubble, and at least somewhat familiar with the unraveling of the European markets, little energy is being focused on what may very well be the nation?s next looming fiscal crisis: the large volume of commercial real estate debt maturing during the next seven years.

According to Trepp, a provider of CMBS analytics and data to the securities and investment management industry, there will be more than $2 trillion of commercial real estate loans maturing by 2017. It?s estimated that half of them are ?underwater.? This means that fully $1 trillion in commercial real estate loans will mature without a clear refinancing strategy. These loans will not be refinanceable at existing debt levels, due to a decrease in underlying asset value. And today?s lending standards are much tighter than those of the middle 2000s, which further compounds the problem.

The lenders holding these overvalued loans will seek to either (1) right-size the loan balance at maturity through a large equity injection by the borrower (if an extension is even entertained), (2) foreclose on the loan and sell the underlying collateral or (3) sell the loans at the maximum price attainable (oftentimes at a discount to the par value). In each of these resolutions, there will be significant opportunity for borrowers and third-party buyers alike to purchase real estate or real estate debt at significant discounts to legacy value.

This massive de-leveraging of commercial real estate not only creates valuable buying and restructuring opportunities, it also highlights an even larger underlying problem: Who is going to be the capital provider for these fast-moving and non-traditional real estate transactions?

All-Too Common Scenarios

A commercial real estate developer that financed a retail project in 2005 today finds that the property is now worth less than the face value of the debt owed on the asset.

Tenants have left the property, rents have fallen from peak pricing and though new tenants are seeking to lease the space at lower rental rates, there is a need for capital to pay for tenant improvements and leasing commissions. To add to the complexity of the situation, perhaps the existing lender has recently called a maturity default and is not willing to offer any extension or forbearance options. Since this loan may be non-recourse, and currently not covering debt service payments, there is little incentive for the borrower to make interest payments out of pocket or inject a large amount of fresh capital into the project to ?right-size? the loan and find a new conventional lender.

In the above scenario, there are several different potential outcomes for the asset, and several pitfalls with conventional financing for each:

1. The original lender forecloses on the asset and sells to a new owner: A new operator sees this as a value investment, but few lenders are willing to lend on an asset that is being operated by a bank or receiver, and is under-performing, and will not cover debt service upon the inception of a new loan. Therefore, only cash buyers can purchase the now distressed asset.? Constraining the buying pool to this group reduces asset pricing, and therefore the bank?s ultimate recovery.

2. The bank offers the borrower a discounted payoff on an existing loan. In this situation, it is very difficult for a borrower to find a new lender to provide the capital to pay off the legacy lender, both because the payoff opportunity is likely only available for a short period of time and because there is institutional reluctance among banks and traditional lenders to replace what is viewed as a competitor?s problem.

3. The bank sells the loan at a discount. Lenders may take this approach to achieve a quicker resolution than they might get through foreclosure and sale, to potentially preserve a banking relationship with a customer, or simply to get the bad loan quickly off the balance sheet. It also allows the legacy lender the ability to avoid the moral hazard of providing the existing ?bad? borrower a discounted payoff opportunity.

Traditional real estate lenders?banks, conduits, and insurance companies?are simply not able to provide the responsiveness and creativity that these scenarios often demand. Typical 60- to 90-plus-day closing timelines, extensive third-party appraisals and multiple layers of management often negate any potential financing before a loan application is even submitted. Accelerated and reliable deal execution is almost completely non-existent in this new lending landscape, and yet it is the most important factor in managing the tremendous overhang of legacy debt.?

Where to Turn?

Commercial real estate bridge capital sources?nimble and capable debt and equity providers?are stepping up to fill the void that conventional lenders can?t and won?t. Niche capital sources will indeed welcome the opportunity to provide the borrower the necessary proceeds for a short period of time to re-stabilize the asset, and ultimately refinance it at an appropriate debt level.

Such a partner can:

1. Provide the debt necessary for the operator to quickly purchase and re-stabilize the property so that it will be more financeable in the traditional real estate debt markets.

2. Seek out these value opportunities and can provide the capital necessary to allow the borrower to take advantage of a discounted payoff opportunity. The borrower would use the lender?s proceeds for a short period of time to re-stabilize the asset, and ultimately refinance at an appropriate debt level with a traditional real estate lender.

3. Facilitate opportunities for a new value-seeking borrower to purchase a property that a traditional lending source may not want to lend on, particularly if it has been neglected by the prior owner.

4. Acquire notes to manage, service and work out, potentially in partnership with the original borrower.

To Make Matters Worse?

Compounding this problem can be issues of deal size and geography. Transitional situations are more typical for loan and property sizes under $10 million?too small for larger institutional investors to take interest in. Furthermore, coastal money tends to focus on the coastal markets, often ignoring underserved areas needing these types of solutions and relief, such as Nashville, Dallas, Phoenix, Detroit, Houston, Charlotte, Cleveland, Tampa and Atlanta.? Some examples of transitional financing successes:

  • One instance is a 312-unit apartment complex in Dallas, a property that was originally acquired in 2006 for $14 million and financed with $10 million in debt. The deterioration of real estate values in 2008 resulted in the property becoming overleveraged. This, along with the borrower?s expectation that it would lose the property, resulted in reduced investment and focus on the asset.

    Ultimately, in the interest of avoiding a lengthy and costly foreclosure, receivership and liquidation process, the lender offered the borrower a discounted payoff of the loan for $5 million, or 50% of the legacy debt amount. But the payoff would have to occur within three weeks.

    Fortunately, this borrower was able to secure a $5.2 million mortgage loan in this time-compressed situation. The recapitalized balance sheet and additional term allowed the borrowers to reinvest time and capital in the asset. The borrowers stabilized the property and ultimately refinanced the bridge loan within 13 months.

  • Another interesting success story is a 300-unit hotel located in Lexington, Ken. The property was one of the last non-franchised assets owned by a major flag operator and was being acquired by an experienced hotel operator planning to reposition the hotel under a new flag. Traditional financing for this transaction was unavailable because it involved a complicated ground lease, brand transition and a short time frame to close. Closer examination revealed a backlog of room bookings, projected event-based market factors, and low loan-to-replacement value.

    The operator was able to secure a 12-month, $4.9 million loan that gave the borrowers time to transition the brand, stabilize the asset, and refinance into long-term debt with an SBA loan.

  • In Memphis, the operator of a 150-unit apartment building had borrowed $4.4 million against the property in 1999 and eventually lost it to foreclosure in 2009.The prior lender took the property back as real estate-owned (REO) in September 2009 and sold it in May of 2010 to a new investor that needed financing. The new owner acquired the property for $2.9 million and invested $700,000 in acquisition equity in addition to escrowing $550,000 for capital improvements.

    Abridge loan of $2.2 million was used to finance the transaction. This loan represented a 50 percent discount to legacy debt, and less than $15,000 per unit. This creative loan gave the borrower time to make capital improvements to the asset and stabilize the occupancy; it was eventually refinanced by a $3.6 million Fannie Mae loan.

Getting Creative

For brokers, borrowers and lenders alike, the lessons are these:

1. Don?t assume. There is a danger in assuming the banks are freely lending again?and equal folly in assuming that there are no capital providers looking to invest in opportunistic situations. Do your homework and evaluate all options.

2. Understand your position and desired outcomes. If you are a property owner, do you want to retain the asset and create value, but feel like you?re in a no-win situation with your current debt situation? Determine what your true endgame is?it?s often not default?and find the solution that will achieve it.

3. Time is of the essence. Know your time horizons. If traditional lending sources are not going to be an option for you to restructure your debt, it?s better to know that as early as possible so that you can start making plans B and C.

4. Deal with trusted partners.The dynamic financing markets, coupled with the great need for capital, and the promises of new and lucrative opportunities have given rise to a lot of new names and players promising solutions that they cannot deliver. Do your homework, get references, and make sure you are dealing with capitalized partners that have a verifiable track record of honest and responsive business practice.

Ultimately, the chief lesson is this: We must recognize the reality and severity of the times that lie before us. The over-leveraging of over-valued properties pre-2008 will not be solved by organic value growth, increasing rental revenue, inflation or otherwise.? The near-term expiration of nearly $1 trillion in legacy debt will require a broad-based de-leveraging, and the entire universe of players in the commercial real estate market?from borrowers to lenders and brokers?need to work in concert to develop creative, flexible solutions for the spectrum of property owners throughout the country that will need them.

Outrage in Michigan ? Monroe County set to kill pet dogs for ...

Ernest Dempsey ? Killing Ace wasn?t the end of it; Michigan is doing it again as Monroe County is all set to put to death an entire family of boxer dogs because one of them bit a girl who allegedly trespassed the owner?s property while he was away. While the one, a female dog named Brooklyn, did bite the teenage girl, the other three living as part of the family have been arrested and kept imprisoned for 7 months under the label ?dangerous? without any reason and are now close to be killed by the animal control.

The story of the four boxers has been posted on the dogs? Facebook page and owner Timothy Iocoangeli, 48, has been struggling all around to save his dogs from open victimization at the hands of animal control and the courts ? all of whom have refused to give the dogs a chance at fair trial in light of evidence and then decide about them.

As he describes in the facebook post, when Timothy Iocoangeli was way on April 24 this year, Brooklyn bit a teenage girl accompanied by a another teenager, both friends of Iocoangeli?s son; according to Iocoangeli, one of these visitors opened the gate to the house while visiting his son but without caring for the presence of dogs in the house. The girl was bitten bad by Brooklyn because, as Iocoangeli explains this female dog had five of her 2-month-old puppies in her care at the house.

The animal control responded by seizing all dogs without bothering which or any of them were dangerous, including the puppy. To facilitate this injustice, media at once called the incident as attack by a? pack of vicious dogs? even though no assessment was done by anyone of the dogs. Interestingly, the channel reporter tells that the girl was reportedly ?inside the house? when she was attacked. Why would a teenage girl go inside the house without being accompanied by the owner or his son? Nobody has been bothered with this question while it remains at the core of the entire case.

In declaring Iocoangeli?s boxers dangerous, the animal control and judges at the hearings entirely ignored the city?s own law which states that a dog cannot be considered dangerous if it attacks in protecting its property against strangers. In other words, biting a trespasser does not prove a dog dangerous. And even if one dog is prove dangerous ? which will surely be not easy to prove objectively because of the defense reason ? why do other dogs have to be killed in absence of any evidence of any biting or mauling?

As the owner tells, an officer at the animal control offered her release of the dogs if he could pay $3000 within a week. But when he excused for not being able to afford it, the dogs were kept in the pound and the owner or his family was not allowed to visit them. Imprisoned for no crime, kept isolated from family, these dogs have been so recklessly victimized by the city that the ideal of justice has been strangled well before putting the dogs down. And if that was not enough, Timothy Iocoangeli was given a choice by the prosecution to either give up on all dogs or else go to jail. Iocoangeli says he turned himself in instead of letting his dogs be euthanized by his agreement. While he was released on bail, he still faces jail time for up to 4 years on charges of keeping ?dangerous animals? in the house while his dogs can be put to death any time by the animal control.

One act of carelessness by visiting teenagers has literally destroyed the happy life of a man who even washed cars to raise money for saving his beloved family pets. Monroe County animal control and city authorities chose to victimize innocent animals and a man who refused to accept their twisting of their own rules for a show of efficiency and mock justice. Can such an outrage be acceptable in country which is leading the world in matters of rights and justice? Is it not an open act of judicial murder? Allowing such abuse of authority can no doubt lead to future victimization of civilians in the name of management and control.
