(AP) ? Mexico is putting up wind power turbines at a breakneck pace and the expansion is pitting energy companies against the Indians who live in one of the windiest spots in the world.

The country is posting one of the world's highest growth rates in wind energy, and almost all of it is concentrated in the narrow waist of Mexico known as the Isthmus of Tehuantepec, where winds from the Pacific meet winds from the Gulf of Mexico, spawning places so wind-blown that one town's formal name is simply "Windy."

The largely indigenous residents of the Isthmus complain that the wind farms take control of their land, affect fish and livestock with their vibrations, chop up birds and pit residents against each other for the damage or royalty payments. They also claim they see few of the profits from such projects.

President Felipe Calderon has made the inauguration of wind parks one of the main focuses of his administration's ambitious pledge to cut Mexico's carbon emissions by 30 percent by 2020, and on Tuesday ? as he has done before ? he stopped by the state of Oaxaca to inaugurate a new clutch of wind turbines, praising the extra income they provide for some farmers.

"Yes, you can fight poverty and protect the environment at the same time. This is a clear example," Calderon said at the opening ceremony.

But as in the past, he did so under tight security, as local protesters threatened to mar the inauguration. The president's office normally publishes a detailed schedule of his planned activities, but didn't do so with Tuesday's inauguration, keeping it under wraps until the event took place.

So far in 2012, Mexico has posted a startling 119 percent increase in installed wind-power capacity, more than doubling the 519 megawatts it had last year, the highest annual growth rate listed in the magazine Wind Power Monthly's "Windicator" index. Mexico had only 6 megawatts when Calderon took office in 2006.

While Mexico, with a total of around 1.3 gigawatts of wind power, is still a tiny part of the world's estimated 244 gigawatt capacity, it offers an insight into what happens when the industry focuses overwhelmingly on large farms dominated by large companies that are concentrated in a small, desirable area.

It has been mainly Spanish firms like Iberdrola, Union Fenosa and Gamesa, and U.S. firms like Sempra Energy, that have built the huge wind towers that now crowd the Isthmus of Tehuantepec, leaving the local population feeling invaded. Only 4 of Mexico's 17 wind farms are located outside the isthmus.

It raises the question of whether bigger is always better.

"We are asking these multinationals to please get out of these places," said Irma Ordonez, an activist from the Zapotec Indian town of Ixtepec, Oaxaca. "They want to steal our land, and not pay us what they should."

"When they come in they promise and promise things, that they're going to give us jobs, to our farmers and our towns, but they don't give us anything," said Ordonez, who traveled to Mexico City in October to protest outside the offices of a Mitsubishi Corp.

Industry sources say the distrust is unmerited, given the potential benefits to the poverty-stricken farming and fishing towns on the isthmus.

The latest battle focuses on a huge, 396-megawatt off-shore wind farm planned for a narrow spit of land in a lagoon near the village of San Dionisio del Mar, Oaxaca.

A source close to the project, who was not authorized to speak on the record, said the project had been approved by village assemblies, would have little impact on fishing activities in the lagoon and would contribute an amount equal to about half the township's annual budget in coming years in compensation and royalties.

But opponents and supporters engaged in a tense standoff outside the town in October, when a group of men blocked roads to prevent a planned demonstration against the wind farm.

Saul Celaya, a Huave Indian farmer and San Dionisio resident, said the lagoon project would damage mangrove swamps where fish, shrimp and other sea life breeds, and scare off the fish that locals depend on.

"Just when they were doing soil studies, there was a mass die-off of fish," Celaya said, adding that projects opponents "are being intimidated, they're afraid to leave their houses, they're threatened."

The industry source denied the company was intimidating anyone, but acknowledged the project had suffered some delays due to disputes within the community.

Others say it didn't have to be this way, big corporations pitting villagers against villagers. There are proposals to have local towns start their own wind farms, so that they could decide where they would be situated and where profits should go.

Rodrigo Penalosa, an activist who supports the town of Ixtepec's proposed 100-megwatt community wind farm, noted that "the community has already approved it. The problem is that the (government) Federal Electricity Commission won't allow the community project to get access to the network.... but it does allow the multinationals access."

Sergio Oceransky, whose Yansa Group is trying to help kick-start the community wind project, said the commission is asking for financial guarantees of millions of dollars "that no community in Mexico could meet."

"These are requirements that are basically designed to ensure that only projects presented by multinationals can compete," said Oceransky, who claims that such guarantees are not required by federal law.

The commission did not respond to repeated requests for comment.

With a limited transmission capacity for the projects, and the last lots of line capacity being auctioned off, the situation is becoming critical; what could be a sterling example of alternative energy production is threatening to become a permanent political dispute in southern Mexico.

"This is the last chance," Oceransky says.

The effects of online porn on some children were significant, with research revealing that a third of people aged 16 to 24 found sex with partners difficult later in life after viewing porn.

The Plymouth study also shows that children as young as 11 are encountering online porn. The study also reported that by age 14, a majority of kids have viewed pornographic imagery.

Professor Phippen argued the government needs to realize online porn is no longer just for deviant youth.

?The information gathered will now be used to look at how our education system addresses this issue in schools,? he said. ?Pupils have told me that this sort of stuff isn?t covered in their sex education lessons and they want it to be. New target for cancer research uncovered

ScienceDaily (Oct. 24, 2012) ? In a new paper released October 24 in Nature, BioFrontiers Institute scientists at the University of Colorado Boulder, Tom Cech and Leslie Leinwand, detailed a new target for anti-cancer drug development that is sitting at the ends of our DNA.

Researchers in the two scientists' laboratories collaborated to find a patch of amino acids that, if blocked by a drug docked onto the chromosome end at this location, may prevent cancerous cells from reproducing. The amino acids at this site are called the "TEL patch" and once modified, the end of the chromosome is unable to recruit the telomerase enzyme, which is necessary for growth of many cancerous cells.

"This is an exciting scientific discovery that gives us a new way of looking at the problem of cancer," Cech said. "What is amazing is that changing a single amino acid in the TEL patch stops the growth of telomeres. We are a long way from a drug solution for cancer, but this discovery gives us a different, and hopefully more effective, target."

Cech is the director of the BioFrontiers Institute, a Howard Hughes Medical Investigator and winner of the 1989 Nobel Prize in chemistry.

Co-authors on the study include postdoctoral fellows Jayakrishnan Nandakumar and Ina Weidenfeld; University of Colorado undergraduate student Caitlin Bell; and Howard Hughes Medical Institute Senior Scientist Arthur Zaug.

Telomeres have been studied since the 1970s for their role in cancer. They are constructed of repetitive nucleotide sequences that sit at the ends of our chromosomes like the ribbon tails on a bow. This extra material protects the ends of the chromosomes from deteriorating, or fusing with neighboring chromosome ends. Telomeres are consumed during cell division and, over time, will become shorter and provide less cover for the chromosomes they are protecting. An enzyme called telomerase replenishes telomeres throughout their lifecycles.

Telomerase is the enzyme that keeps cells young. From stem cells to germ cells, telomerase helps cells continue to live and multiply. Too little telomerase produces diseases of bone marrow, lungs and skin. Too much telomerase results in cells that over proliferate and may become "immortal." As these immortal cells continue to divide and replenish, they build cancerous tumors. Scientists estimate that telomerase activation is a contributor in up to 90 percent of human cancers.

To date, development of cancer therapies has focused on limiting the enzymatic action of telomerase to slow the growth of cancerous cells. With their latest discovery, Cech and Leinwand envision a cancer drug that would lock into the TEL patch at chromosome ends to keep telomerase from binding there. This approach of inhibiting the docking of telomerase may be the elegant solution to the complex problem of cancerous cells. Cech, a biochemist, and Leinwand, a biologist, joined forces to work on their latest solution.

"This work was really made possible by the fact that our labs are so close," Leinwand said. "My lab was able to provide the cell biology and understanding of genetics, and Tom's lab allowed us to explore the biochemistry. We have a unique situation at BioFrontiers where labs and people comingle to make discoveries just like this."

Leinwand is the chief scientific officer of the BioFrontiers Institute and a professor of molecular, cellular and developmental biology.

Vatican court: Butler's theft harmed pope, church

VATICAN CITY (AP) ? The Vatican tribunal that convicted the pope's ex-butler of stealing private papal correspondence sharply condemned the theft on Tuesday as causing "reprehensible" damage to the pontiff, the Holy See and the entire Catholic Church, and said investigations are continuing.

The three-judge tribunal issued its written explanation of how it reached its Oct. 6 verdict against Paolo Gabriele, who was convicted of aggravated theft and sentenced to 18 months in prison, currently being served under house arrest.

Gabriele confessed to photocopying papal documents and giving them to an Italian journalist, saying Pope Benedict XVI wasn't being informed of the "evil and corruption" around him and that he believed that exposing the problems publicly would put the church back on the right track.

The revelations of petty bureaucratic infighting, intrigue and allegations of corruption and homosexual liaisons marked the biggest Vatican security breach in modern times.

Noting what they called Gabriele's "simplistic" intellectual capacity, the judges acknowledged that he had thought he was doing the right thing by leaking the documents. But they said Gabriele's crime was a "reprehensible" violation of trust that damaged the pope himself and the rights of the Holy See, the Vatican City state and the entire Catholic Church.

The Vatican spokesman, the Rev. Federico Lombardi, noted that the investigation into Gabriele remains open and that prosecutors could charge him with other crimes.

Lombardi repeated that Benedict has the authority to pardon Gabriele. On Oct. 6 Lombardi had said a papal pardon was "concrete, likely" ? though on Tuesday he would only say it was "a possibility" and that it wasn't known if or when a pardon might be granted. He said his choice of words Tuesday was intentional.

Prosecutors have a few more days to decide whether or not to appeal the sentence, as they can do in the Vatican. Gabriele's attorney has decided not to appeal.

Once the deadline passes, Gabriele will begin serving his sentence in a Vatican detention facility, Lombardi said. Previously the Vatican had said he would serve it in an Italian prison, given that the Vatican doesn't have a long-term detention facility.

Italian author Gianluigi Nuzzi's book, "His Holiness: Pope Benedict XVI's Secret Papers" convulsed the Vatican for months and prompted an unprecedented response, with the pope naming a commission of cardinals to investigate the origin of the leaks alongside Vatican magistrates.

A co-defendant, Claudio Sciarpelletti, a computer expert in the Vatican secretariat of state, was accused of aiding and abetting Gabriele's crime. Through his lawyer he has said he is innocent. His trial is due to start Nov. 5, Lombardi said.

In their ruling, the judges said there was no proof that Gabriele had any accomplices. Nevertheless, they noted that investigations are continuing "into the existence of other possible responsibilities in the leaks of reserved documents."

They confirmed the conviction of aggravated theft, rejecting the defense claim that Gabriele was merely guilty of "misappropriation" and detailing the way he violated the trust that had been granted him due to his position.

"Gabriele was able to commit the crime because of his relationship of service to the Holy Father, which is necessarily based on trust that allowed the pope to leave in his care documents that he illegally approrpriated," the judges wrote.

They said that while Gabriele himself may not have profited financially from stealing the documents, he obtained an "intellectual and moral" profit by doing so ? a legal requirement to finding him guilty of theft.

Despite the violation, the judges said they could exclude that Gabriele was in general a criminal and, based on the length of his sentence, rejected the prosecutors' request that he be barred from work in any Vatican public office.

Gabriele, a 46-year-old father of three, is a Vatican citizen and resident of the Vatican city state. Lombardi said he didn't know if he was continuing to draw a salary or whether he would continue to be granted Vatican citizenship.

This land is my land: Arizona fights to own the Grand Canyon

PHOENIX (Reuters) - When voters in Arizona go to the polls next month, they will be asked to decide a landownership tug of war: Should the Grand Canyon belong to all Americans, or just the residents of Arizona?

A controversial ballot measure backed by Republicans in the state legislature is seeking sovereign control over millions of acres of federal land in the state, including the Grand Canyon.

Proposition 120 would amend the state's constitution to declare Arizona's sovereignty and jurisdiction over the "air, water, public lands, minerals, wildlife and other natural resources within the state's boundaries."

The measure is the latest salvo in the so-called "sagebrush revolt" by Republicans in the West aiming to take back control of major swaths of land owned by various federal agencies, much of it by the Interior Department's Bureau of Land Management.

State Senator Sylvia Allen, one of the Republican backers of the measure, argues that federal retention of the land hurts the economy of the Western states and leaves them struggling to fund public education, nurture their economies, and manage their forests and natural resources.

"We do not have the ability in rural Arizona to provide jobs for our citizens due to the fact that the federal government controls all the land," Allen told Reuters. "It leaves us at a great disadvantage. We're not able to bring in industry and provide for the jobs that we need," she added.

The exact area of public land targeted by the measure - which excludes American Indian reservations and federal installations such as arsenals - was not immediately clear on the Arizona Secretary of State's website.

The Sierra Club pegged the area at between 39,000 and 46,700 square miles (101,000 and 121,000 square km) - or 34 percent to 41 percent of the entire state.

BATTLE OVER LAND

The ballot measure is just the latest move in a decades-old federal-state skirmish over control of a wide range of natural resources in Western states, often pitting mining, drilling and logging companies against those seeking to protect the environment.

The efforts have had mixed success. In May, Arizona's Republican Governor Jan Brewer vetoed a state bill calling on Washington to relinquish the title to 48,000 square miles (124,000 square km), arguing that it created uncertainty for existing leaseholders on federal lands in difficult economic times.

But similar legislation was signed into law by Governor Gary Herbert in neighboring Utah in March, despite warnings from state attorneys that it was likely unconstitutional and would trigger a costly and ultimately futile legal battle.

Opponents of the latest drive to assert Arizona's ownership say that, if successful, the initiative could undermine protections provided by federal environmental laws such as the Clean Air Act, Endangered Species Act, and Clean Water Act, and would saddle Arizona with lands for which it would be unable to care.

"They can't even fund and ensure that their (state) parks are protected, so how they would take on an additional 25 to 30 million acres of land is a big question mark," Sandy Bahr, director of the Sierra Club Grand Canyon Chapter, told Reuters.

No polls have given a sense of whether Prop 120 will prosper during the November 6 election. But Bahr cautioned that, should it pass, it would inevitably trigger fresh litigation for Arizona, which recently fought a legal battle over its tough 2010 crackdown on illegal immigrants all the way to the U.S. Supreme Court.

"This one is just blatantly unconstitutional," Bahr said of Prop 120. "Does Arizona really need another lawsuit?"

Time is tight to get consensus on Egypt constitution: expert

CAIRO (Reuters) - The time left for the completion of Egypt's constitution might not be enough to resolve disputes which threaten its legitimacy, according to a legal expert who says failure to forge a consensus could lead to instability in government.

The new constitution is a crucial element in Egypt's transition from decades of army-backed autocracy and should bring with it historic changes including guards against the kind of one-man rule seen throughout the Arab world for decades.

The 100-strong assembly writing the constitution has been given six months to ready it for a referendum, which means the drafters have until early December to finish.

The process has been deeply divisive, pitting Islamists who have a strong sway over the process against their more secular-minded opponents on questions such as the role of Islam in the state and human rights. Some of the Islamists' critics have called for a complete boycott of the process.

"I don't think two months are enough, not because the cleavage is great but the lack of trust will take longer to overcome," said Zaid Al-Ali, who advised the Iraqis who wrote their constitution and is now following the process in Egypt.

Separately, activists worried about the rights of women and children met in Cairo on Monday to express opposition to the assembly and the draft it has written. Such protests have become a regular occurrence.

"In Iraq, right from the start, the constitution's legitimacy was challenged, and to this day it is like a set of traffic lights that you respect only when you think it is appropriate," said Al-Ali, who works in Cairo with International IDEA (Institute for Democracy and Electoral Assistance) - an international organisation headquartered in Stockholm.

"The message in that for Egypt is that the more you can get people to agree that the text is a good one, or is good enough for the time being, the greater likelihood you'll have of a well-functioning state," he told Reuters in an interview.

Al-Ali worked with a U.N. mission set up to provide advice to the Iraqis on the constitution that was drafted in 2005. There are no foreign advisors to the Egyptian constitutional assembly. International IDEA, like other foreign organisations, meets informally with the stakeholders, Al-Ali said.

The dispute has been fought out in the courts, where earlier this year a ruling led to the dissolution of the first assembly. The second assembly also faces the risk of dissolution on Tuesday, when a court is due to rule on the legality of its make-up.

Were the body deemed illegal, it would fall to President Mohamed Mursi to pick a new one, presenting the Islamist leader with a headache over whether to meet non-Islamists' demands for a bigger say.

In Al-Ali's assessment, the differences are surmountable. "In Egypt you would think that the positions are so far apart that things were about to collapse altogether, when in fact there is a huge amount of overlap," he said. "They can definitely do it, but they need to trust each other."

MANY UNCLEAR ARTICLES

Al-Ali said flaws and ambiguities in a draft circulated this month by the constitutional assembly partly reflect the haste with which it was written.

There are also hangovers from the previous constitution that are more akin to a traditional Arab autocracy than democracy.

For example, freedoms such as the right to form a trade union will be regulated - according to the draft - by unspecified laws, leaving room for legislators to curb them.

"A lot of the articles just aren't clear," Al-Ali said.

Articles pertaining to the role of Islamic law, or the sharia, are also among those that beg questions.

The current draft has preserved the previous constitution's wording on the role of Islamic law: the "principles of sharia" will be the main source of legislation. Yet a new article explaining the principles of sharia is unclear, as is an article that gives an ill-defined role to Al-Azhar, an Islamic institution, as an advisor on matters pertaining to sharia.

"Different people are already interpreting this in different ways," said Al-Ali. "The current wording will certainly lead to lots of legal problems in the future and many disappointed people, to put it lightly."

Civil rights activists are worried that hardline Islamists will use the language on Islamic law - including an article that ties women's rights to sharia - to curb their freedom and justify violations such as underage marriage and female circumcision.

Mervat Tallawy, head of the National Council for Women, told attendees at the Cairo meeting that the term "rulings of Islamic sharia" tagged to clauses on women creates wiggle room for some Islamist jurists to permit crimes against women and children.

"They can create a distorted image of sharia law, placing it in a position of enmity against women," Tallawy said. "Sharia law is innocent of these charges."

The Samsung Galaxy SIII (S3) has just gone out to MetroPCS stores for widescale availability, so it's fitting that the official Google Wallet twitter account has just confirmed that the device will be compatible with Google's NFC payment system. Galaxy S3 users on the regional carrier will now be able to download the Google Wallet app from the Play Store directly, and have it work at any of the thousands of stores where Google has implemented its Google Wallet payment terminals.

We're happy to see more and more devices supported officially by Google Wallet, especially the more popular ones like the Galaxy S3.

Medicare Changes and Tough Decisions | Michigan Elder Law Center

It isn?t easy to assess all the options: Seniors and other beneficiaries must weigh short-term savings in premiums against long-term costs in co-pays or limited benefits. It is important to consider developing health concerns and how easily they can get access to a favorite doctor or specialist.

With ever-changing co-pays, premiums, and the list of covered drugs, prescription drug plans can be very frustrating and difficult to navigate. But the good news is that more choices can also drive down prices, said, Bettie Hughes, a MMAP coordinator with the Senior Alliance, a federally funded Area Agency on Aging. The Senior Alliance serves seniors in western and southern Wayne County.

Seniors must look around and be weary of individuals trying to advantage: 75-year-old eyes don?t read small print like they used to, and the annual user?s manual from the U.S. Centers for Medicare and Medicaid Services is jargon-filled and confusing. It is also easy to be distracted by the noise of politicians? promises and predictions in an election year.

But as it stands, nothing has been changed to substantially change Medicare,?yet. As is, the idea of offering health insurance to Americans 65 and older and those with certain disabilities ? remains strong, according to Jo Murphy, director of the state MMAP program.

Monday: Open enrollment begins for Medicare Advantage and Part D (drug) plans.
Dec. 7: Open enrollment ends for both.
Jan. 1: New coverage begins in 2013 plans.
Jan. 1-Feb. 14: Medicare Advantage customers can switch to Original Medicare.
Dec. 8-Nov. 30, 2013: Advantage customers can switch to a five-star rated plan.

More Details: About the categories of Medicare coverage

Part A: Provides coverage for hospital care, limited nursing home stays, hospice and some home health care. Most people who have been employed get Part A coverage without having to pay a monthly premium.
Part B: Many seniors purchase this coverage for their physician visits, outpatient services and some medical equipment. Enrollment typically is automatic once you qualify for Medicare. Recipients pay a monthly premium plus a typical 20% co-pay and costs.
Part C: Also known as Medicare Advantage, these plans are purchased through insurance companies and provide more comprehensive coverage. Options might include coverage for prescription and generic drugs, dental and vision care, contributions toward gym memberships, diet-related programs and other care. Impatient Engagement: A wedding, antiques, and classical music

This past weekend Beau and I went out East to visit his family and attend his cousins' wedding. The wedding was beautiful and the reception was so much fun! Before we went, however, I needed a new dress. I drug (not too hard, surprisingly) Beau with me to pick out my dress, with a little bribing of one of his favorite restaurants, and he actually ended up picking out my dress!! I was very impressed with him; I got a green lace dress with sequin accents and it was beautiful. We ended up having to get me new shoes and we also got Beau new tennis shoes and a green dress shirt to match me. We were quite fetching!
??So we drove out for the wedding and had a blast with his family.?I actually did the Apache Song dance with his brother in law. Pretty awesome.
??So then we stayed the night at his parents, as we usually do, and the next day we had breakfast with his parents and then his Dad gave him an early birthday present of 4 new tires on his car (which is awesome because Beau delivers pizza) and his Mom took me to an Antique and Crafts mall. It was great, I haven't been to one in a minute so I was falling dangerously in love with a lot of the things in there. But I ended up being pretty in control and only bought a few things. Beau's mom was super sweet and offered to buy me a couple of things too. And by offered I mean "Did not take no as an answer." ?=)
??Then we all went out for dinner and after watching Beau and his Dad play some wii we drove home. Beau was really sweet and was trying to rush me home in time to watch Once Upon A Time which we thought?started at nine. Even with hitting traffic, he managed to get us home at 8:58! He told me to just grab what I could and run inside which I thought was super sweet. Turns out the show is on at 8 so I ended up missing it, but it was still really awesome that he tried doing that for me. And the whole way home we listened to classical orchestra which was really nice. We just sat back and reminisced about our High School Band days (which was drastically different since his band had about 250 people whereas mine had maybe 60....which was also half my High School) and just enjoyed the music. It was great. Just being together and not thinking and not talking about anything heavy. Just enjoying the strings and horns and bells.

Facebook and other companies that went public recently will start reporting quarterly earnings later this month, generally for the July-September quarter.

Zynga Inc., the maker "FarmVille" and other online games, has announced that it expects a loss for the third quarter due to weak demand for some of its titles. It's also taking a charge related to its acquisition of OMGPop, a mobile game maker, which it bought for $183 million in March. Zynga's stock fell on the next trading day.

Here's a schedule for earnings reports from some tech companies that had IPOs since last year. The companies are all loosely Internet-related, though their businesses vary widely.

Germany likely posted surprise growth in Q3: finmin report

BERLIN (Reuters) - The German economy likely grew in the third quarter despite a weak global backdrop thanks to a strong performance by German industry and robust exports to areas outside the euro zone, the Finance Ministry wrote in its monthly report.

"Expansion in German industrial production...likely gave significant growth impetus. Most analysts did not expect this given the deterioration in the business mood," the report said.

Many economists had forecast the economy would contract in the third quarter, particularly as Germany's closely-watched Ifo business sentiment index worsened for five months in succession.

"All in all, German exports continue to appear robust despite a slow-down in global momentum... Stimulus for the export market came above all from non-euro zone countries," the report said.

German growth slowed to 0.3 percent in the second quarter from 0.5 percent in the first as firms postponed investments due to concerns about the 17-nation bloc's troubles.

The Finance Ministry said in the fourth quarter of 2012 there could be a significant weakening in economic activity, due to the depressed business climate in other euro zone states, but the German economy would pick up gradually during 2013.

Last week the government slashed its 2013 growth forecast to 1 percent from 1.6 percent due to European economic weakness, though it lifted its expectation for 2012 by 0.1 percentage points to 0.8 percent.

Germany's economy powered through the first two years of the euro zone's sovereign debt crisis, posting 4.2 percent growth in 2010 and 3 percent last year at a time when some peers were seeking bailouts and others were grinding to a halt.

However the woes of some of its southern European partners have now started to impact economic performance.

NFLPA cites 1996 bounty program allowed by NFL

NEW ORLEANS (AP) ? The NFL Players Association filed papers in federal court pointing out that the NFL permitted a 1996 incentive program for big hits funded by then-Green Bay defensive lineman Reggie White.

In papers filed Thursday in U.S. District Court, the union questioned why NFL Commissioner Roger Goodell should now be able to suspend former Saints linebacker Scott Fujita for offering then-New Orleans teammates rewards for big plays during the 2009 season.

The filing cited media reports about White's "smash-for-cash" program that paid $500 for big plays, including big hits.

The reports, now nearly 16 years old, include players from other teams discussing similar pools climbing into the thousands of dollars. In one report by ESPN, Troy Vincent, then a defensive back with Philadelphia, discusses a similar player-funded incentive program run by Eagles players.

Vincent now works for the NFL as a vice president overseeing player engagement.

In the reports, an NFL spokesman is quoted as saying the incentive programs are permitted as long as players use their own money and the amounts players pledge are not exorbitant.

NFL spokesman Greg Aiello said Thursday night that the league would defer comment to its own forthcoming arguments in court.

The NFLPA seized upon the NFL's 1996 stance particularly as it related to Fujita, who Goodell suspended this for one game this season even though he said he could not verify that Fujita participated in the bounty program the league says the Saints ran for three seasons from 2009-11. Goodell said Fujita, now with Cleveland, was still guilty of violating NFL rules by offering his own incentives for big plays and also, as a team leader, by failing to try to stop to the cash-for-hits program overseen by then-Saints defensive coordinator Gregg Williams.

The union said that while the NFL's player safety goals may have evolved since 1996, it is unfair to punish players for behavior it previously permitted without formally spelling out that such behavior is no longer allowed.

"The fact that the NFL has a different agenda today than it did in 1996 cannot change the unequivocal language of the NFL Constitution & Bylaws, which has never prohibited this type of behavior," the union wrote in its legal briefs. "The Commissioner's attempt to nonetheless suspend and scapegoat Mr. Fujita for conduct - incentivizing undisputed, legitimate plays - never before punished or prohibited by the NFL not only violates the 'essence of the (collective bargaining) agreement' but further demonstrates the Commissioner's evident partiality."

Fujita is one of four players suspended by Goodell in the NFL's bounty probe of the Saints. Saints linebacker Jon Vilma was suspended for the season, Saints defensive end Will Smith for four games and free agent defensive lineman Anthony Hargrove for seven games. None of the suspensions are currently in effect because they all have been appealed within the framework of the NFL's labor agreement, and Goodell has set hearings for those appeals this Tuesday in New York.

However, all four players also have asked U.S. District Judge Ginger Berrigan to throw out Goodell's disciplinary rulings on the grounds that he has demonstrated a bias against the players in his handling the bounty investigation, thereby violating the players' industrial due process rights. The players also have questioned the credibility of the league's evidence in the case or the witnesses upon which the league's investigation relied.

The NFL has said the union agreed that the commissioner would be able to serve as the lone arbitrator for matters deemed detrimental to football and that the evidence in the case is strong enough to support Goodell's rulings.

Still, the players have argued that Goodell should be barred from handling discipline in the bounty probe and that a neutral arbitrator should be appointed, an argument repeated by the union in its latest filing.

"It is only a neutral of unquestioned integrity who can restore public confidence in this process and mitigate the damage which the NFL's handling of 'bounty-gate has inflicted upon the game," the NFLPA said.

Meanwhile, former Minnesota Vikings defensive lineman Jimmy Kennedy submitted a sworn declaration stating he "knew nothing of any alleged 'bounty' program" that the Saints had in place on quarterback Brett Favre when they faced the Vikings in the 2009-10 NFC title game.

Kennedy's declaration states that he had only told teammates that the Saints were hitting Minnesota players "like there's money on the table," which was his way of urging teammates to match New Orleans' intensity.

Kennedy said NFL investigator Joe Hummel called him to ask about a Saints bounty program, and he told Hummel he did not know anything about it.

"Contrary to the League's claims, I did not act as a 'whistleblower,'" Kennedy stated.

An NFL memo from the bounty probe has indicated that Kennedy told then-Vikings coach Brad Childress about a Saints bounty on Favre after discussing it with Hargrove, his former teammate in St. Louis.
